Our partner, lawyer Alberto Romero, has managed to get a client to recover the money that was stolen after suffering the theft of his personal data, with which the fraudster accessed his electronic banking.
The Court considers that the Bank must be responsible for reimbursing the stolen money to our client, having not established the necessary security measures to prevent it.
Nor has the Bank been able to prove that our client acted with gross negligence, since the fraudsters used a sufficiently sophisticated method to obtain personal data without too much suspicion.
In particular, the Judge has taken into account the speed of our client in realizing the deception, who contacted the Bank at minute 1 and reported the facts to the Civil Guard that same day.
